Terms of Service

Effective

English summary. This page is an English summary of our Terms of Service, written to help you understand them. The Korean Terms of Service are the official version. If the two differ, the Korean version applies.

Thank you for using EtherXync. These terms set out what the operator and the people who use the service promise each other.

1. Purpose

These terms cover your use of the services EtherXync (“the operator”) provides at etherxync.com (“the service”), and set out the rights, duties and responsibilities of the operator and of users.

2. Definitions

  1. “Service” means every feature the operator provides at etherxync.com and its sub-addresses.
  2. “User” means anyone who uses the service under these terms, with or without an account.
  3. “Member” means a person who agreed to these terms and created an account.
  4. “Guest” means a person who uses the service without an account.
  5. “Post” means anything a member puts on the service: posts, comments, links and similar.
  6. “Username” means the public name a member chooses so others can recognise them.

3. Posting and changing these terms

  1. A link to these terms is at the bottom of every page.
  2. The operator may change these terms within the limits of Korean law, including the Act on the Regulation of Terms and Conditions and the Act on Promotion of Information and Communications Network Utilization and Information Protection.
  3. Changes, their effective date and the reason are announced on the notice board at least 7 days in advance. Changes that are unfavourable to members are announced at least 30 days in advance, and also sent to the email address you signed up with.
  4. If you do not agree with a change, you can stop using the service and delete your account. If we told you that staying silent until the effective date counts as agreement, and you did not object, you are taken to have agreed.

4. What the service offers

  1. The service includes:
    1. Ether Library: Korean translations of public-domain classics, to read online and download as e-books (EPUB, PDF)
    2. Games: browser games with saved scores and leaderboards
    3. Apps: information about the operator's apps and launch notifications
    4. Community: posts, comments, votes, reports and user pages
    5. Studio: enquiries about development work and collaboration
    6. Other services the operator adds and announces (for example, AI launch notifications)
  2. The service is free. Paid passes for the operator's apps are bought through the app store, as described in section 14.
  3. Each page explains what is open to everyone and what needs an account. Reading past a book's first chapter, downloading e-books, posting, commenting, voting, reporting, playing games and saving scores, getting apps and signing up for launch notifications are for members.

5. Changes and interruptions

  1. The operator may change all or part of the service for operational or technical reasons.
  2. The service may pause for maintenance, equipment failure, network problems or outages at the outside services we rely on (web hosting, sign-in and database).
  3. If the whole service is shut down, members are told on the notice board and by email at least 30 days before.

6. Creating an account

  1. Your account is created when you agree to these terms and the Privacy Policy, sign up with an email address, password and username, and the operator accepts. If email confirmation is required, sign-up finishes once you confirm.
  2. You must be 14 or older.
  3. One person, one account.
  4. The operator may refuse a sign-up, or end the agreement later, if someone uses another person's email or details, is under 14, makes several accounts, was previously removed for breaking these terms and rejoins without permission, or gives false information or breaks the law.

7. Usernames

  1. Usernames are 2 to 20 characters: Korean letters, English letters, numbers and underscores (_). They must be unique, ignoring upper and lower case.
  2. You may not use a username that could be mistaken for the operator or a moderator, impersonates someone, contains abuse, hate or obscenity, includes someone else's personal details, or infringes someone's trademark or other rights.
  3. You can change your username in My page. The operator may ask you to change a username that breaks rule 2, and may restrict your account under section 12 if you do not.

8. Looking after your account

  1. Keep your email and password to yourself. You may not lend or transfer your account.
  2. If you think someone else is using your account, change your password straight away and tell us.
  3. Unless the operator was at fault, the operator is not responsible for losses caused by not following rules 1 and 2.

9. Your responsibilities

Please follow the law and these terms. In particular, do not:

  1. Spam: post ads or promotions, repeat the same post or comment, or create posts, comments, votes or game scores with automated tools
  2. Attack others with abuse, insults, harassment, threats, hate speech or discrimination
  3. Post or spread someone's real name, contact details, address, photos or other personal information without their consent
  4. Post content that infringes copyright, trademarks or other intellectual property
  5. Cheat in games with bugs, macros or edited scores, or manipulate leaderboards
  6. Post obscene or illegal material, or content that encourages crime
  7. Impersonate the operator, a moderator or anyone else
  8. Disrupt the service through hacking, getting around security, or excessive requests
  9. Use another member's account or secretly collect other users' information
  10. Do anything else that breaks the law or these terms

10. Rights in content

  1. You keep the copyright in what you post.
  2. You give the operator a free, non-exclusive permission to show your posts on the service and to copy, transmit and display them as far as needed to run the service. Any wider use needs your consent first.
  3. That permission ends when you delete the post or your account. To keep conversations readable, the place where a deleted post was remains.
  4. The Ether Library translations are by EtherXync and are licensed under Creative Commons Attribution-NonCommercial 4.0 International (CC BY-NC 4.0). Anyone may use them under that licence. The original works are in the public domain.
  5. Apart from the translations (rule 4), the sound samples (rule 6) and the score engravings (rule 7), the design, logo, games, apps, writing and other content made by the operator belong to the operator and may not be copied or distributed without permission.
  6. The instrument sounds in the game Xync are adapted from samples others have shared. CC BY 3.0 samples: violin, trumpet and tuba from tonejs-instruments (Nicholaus P. Brosowsky, based on Versilian Studios VSCO 2), and viola from the FluidR3 GM soundfont (Frank Wen, MIT licence) as rendered by gleitz/midi-js-soundfonts. CC0 1.0 samples: Versilian Studios' VSCO 2 Community Edition, Versilian Community Sample Library and Virtuosity Drums, and Karoryfer Lecolds' Growlybass and Meatbass (played by D. Smolken). Use of these samples follows their licences.
  7. The scores in Xync are arranged from engravings of public-domain works published by The Mutopia Project (mutopiaproject.org). Licences differ by piece. Those not in the public domain: Mussorgsky and Rimsky-Korsakov's “Night on Bald Mountain” (piano arrangement by K. Chernov) adapts Robert Clausecker's engraving (CC BY 3.0). While we replace pieces with new ones, some remaining engravings follow Creative Commons Attribution or Attribution-ShareAlike licences.

11. Moderation and reports

  1. If a post breaks section 9 or the law, the operator may remove it without notice. The content is deleted and only a placeholder such as “This post was deleted” remains.
  2. Members can report posts and comments. The operator reviews reports and acts where needed.
  3. If a post invades your privacy, defames you or otherwise violates your rights, you can ask for it to be removed at [email protected]. The operator will act as required by Korean law.
  4. The member who posted something is responsible for it.

12. Restrictions

  1. Depending on how serious a breach is, the operator may warn you, remove posts, suspend your account for a period, or end the agreement.
  2. If you disagree with a decision, write to [email protected]. The operator will review it and reply.

13. Deleting your account

  1. You can delete your account at any time in My page (/me/).
  2. Your account, profile (username and bio), game scores, votes, launch notifications, reading positions and reports are deleted straight away.
  3. The content of your posts and comments is deleted. To keep conversations readable their place remains, and the author is shown as “Former member”.
  4. Deleting an account cannot be undone, and deleted records cannot be restored.

14. Buying apps

  1. The operator's apps (for example, One Page English) are downloaded and paid for on Google Play. Payments, refunds and passes follow Google Play's terms and refund policy.
  2. This website does not take payments. It introduces the apps and links to the store.
  3. Each app's features and conditions are as described in the app and on its page here.

15. Limits of liability

  1. The operator is not responsible for losses that happen without the operator's intent or negligence, such as natural disasters, war, outages at outside services, or a user's own mistakes.
  2. For the free service, the operator is not responsible for users' losses unless caused intentionally or by gross negligence.
  3. The operator does not guarantee the accuracy of members' posts, has no duty to step into disputes between users or with third parties, and is not responsible for losses from them.
  4. Outside sites we link to (for example, Google Play) are responsible for their own content and transactions.
  5. We work hard to translate faithfully, but if you rely on a translation for academic, legal or other important decisions, please check it against the original.

16. Privacy

The operator protects your personal information as required by law and as described in the Privacy Policy.

17. Notices

  1. Notices for one member go to the email address used to sign up.
  2. Notices for all members may be posted on the notice board for at least 7 days instead of individual messages. Anything that significantly affects members' rights and duties is sent individually.

18. Governing law

  1. These terms and your use of the service are governed by the laws of the Republic of Korea.
  2. If a dispute arises, both sides will try in good faith to resolve it. If that fails, either side may bring a case before the competent court under the Korean Civil Procedure Act.
